1)  APPLICATION:-

  • These terms and conditions will apply on the purchase of goods by the consumer/ end user.
  • We're Miyar.pk and is registered under parent company KNS Technology with the registered number ______________ & official e-mail addresses  [email protected],  [email protected].
  • Official registered office of Miyar.pk is KNS Technology, Office 1, 3rd floor, Musarat Arcade, Sector: G-11 Markaz, Islamabad, Punjab 44000.
  • Management reserves the right to make all required amendments in T&C deemed necessary and will be intimated to consumers via notifications (sms, e-mail , whatsapp etc) whichever is applicable.
  • There're the basic terms & condition on the basis of which we will going to sell goods online to potential customers/end users.  By ordering any goods online, you agree to these T&C.
  • By placing an order on the website you'll be asked to accept T&C of purchase and end user need to click on "I Accept" button after which consumers can complete their orders online.

 

 

2) INTERPRETATION:-

  • Consumer means an individual whose making a purchase online or placing an order after accepting T&C.
  • Contract means the legally binding agreement between Miyar.pk and the end user/consumers  for the sale of goods or services online via our platform.
  • Delivery location means the physical address/warehouse where the goods have been stored for the purpose of sending them to consumers after they've placed an online order onto our website.
  • Durable Medium means the paper or e-mail address through which any information will be conveyed to the recipient for prior intimation or notice if any change is necessary.
  • Goods means the items and products that we've listed on www.Miyar.pk website for buying by the end user after they've placed an online order by accepting T&C respectively.
  • Order means the consumer intention of buying a product/item online on www.Miyar.pk through the procedure mentioned online.
  • Privacy Policy means the set rules on our website which govern how we'll (Miyar.pk) going to deal with the confidential details and personal information of consumers who registered themselves online via our website.
  • Website means our website (www.Miyar.pk) on which various products/items will be listed/advertised for the sake of buying.

 

3) Goods:-

  • The goods have been advertised/listed on website, brochures, catalogues etc
  • In case of product's customization, the consumer is responsible for providing exact and correct details otherwise the company will not be held responsible.
  • All goods that are listed onto the website are subject to availability by www.Miyar.pk and if required replenishment will be done on urgent basis so as to make buying  convenient and hassle-free.
  • We can make changes to the goods which are necessary to comply with any applicable laws and safety requirement. We'll notify consumers of any change we make.

4) Personal Information & Registration:-

  • When registering to use the website consumers need to setup a username and password. Consumers will be held responsible of all the actions performed under their respective username and password. They should not disclose their unique credentials with anyone else and remain them secret to themselves.
  • All consumer details provided under privacy policy will be strictly confidential and is the responsibility of the company to make it secure in their records and are not disclosed to anyone.
  • We may contact you via e-mails, sms whatsapp etc what you 've provided in your bio data for any promotional messages and offers on our website.

 

 

5) Basis of Sales:-

  • The description of goods on our website does not constitute a contractual offer of binding to sell the goods. When an order is placed we can reject it for any reason that we'll going to tell you later.
  • The order procedure is mentioned onto the website. Each process allows you to amend errors before submitting it. It's your responsibility to make sure the details are free from any discrepancies whatsoever.
  • A contract will be formed for the sale of goods ordered only when you receive an email confirmation from us.
  • All quotations will be valid for a fix period of 7-days.
  • These terms and conditions are applicable to you as a consumer. In other case like the www.Miyar.pk/Wholesale we'll going to provide you with a separate contract which govern its laws set out for wholesale business empowerment.

 

6) Price & Payment :-

  • The price of the goods or any additional delivery and other charges that are applicable are mentioned on our official website at the date of the order placed.
  • Price and charges include VAT at the rate applicable at the time of the order.
  • You must pay by submitting your Debit or Credit card details. Other than that cash on delivery (COD) is also possible. 

 

7) Delivery :-

  • We'll deliver the goods to the delivery location within the time or within the agreed period.
  • In events which are beyond our control and because of which the delivery is late, we'll going to convey you the reasons and causes which led to the late package delivery.
  • If the product is out of stock, we will mention that onto our website listings, so that you may know and refrain from placing the order.
  • Products listed online on our website (www.Miyar.pk) are only available in the region of Federal Capital Islamabad only.
  • For urgent deliveries within 24-hours, the customer needs to pay additional charges with respect to their delivery address mentioned by them.
  • If you or your nominee fail to prove our fault in delivery service to deliver products onto the delivery location mentioned, we may charge the reasonable fees for redelivering the package to the correct location.
  • Once the goods have been delivered successfully at the delivery address then it becomes the responsibility of the buyer for its usage. You must examine the goods well before accepting them and sign the receipt if you found them right. After signing we will not be responsible for any discrepancies whatsoever arises afterwards.

8) Risk & Title :-

  • If for instance the goods reached to you with a fault or a different item has reached you which wasn't ordered on the website, you can return them right-away with the comment and handover it to our delivery rider.
  • You do not own the goods until we've received the payment in full.
  • If full payment is overdue or a condition occurs towards your bankruptcy, resulting in you not able to make the required payment for the item, we can choose by notifying you to cancel the delivery and end any right for you to use the product, in which case you must return them immediately or allow us to collect the item.

 

9) Withdrawals  Returns & Cancellation :-

  • You can withdraw the order if it is in the processing phase before vendor intimation, without any reason or simply of you've changed your mindset.

10) Conformity & Guarantee:-

  • We at Miyar.pk have a legal obligation and conformity to deliver the goods to buyers who've placed their orders through our official (www.Miyar.pk) website.
  • Quality assurance & customer satisfaction is our utmost priority. We assure you that :-
  1. Product quality will be inspected before delivery and at the time of delivery you can inspect the item ordered and if found faulty/damaged, you can return the product right away to our delivery rider without making the payment, no questions asked.
  2. Be reasonably acceptable for any reason that it was ordered otherwise it can be returned either for a refund or a replacement. COD is also available along with other payment options like Credit card/Debit card.
  3. Conform to their description.
  1. We'll not be held responsible for the product's discrepancies/fault/malfunction if it's been misused or not in accordance with the guidelines mentioned in their user's manual respectively.

We'll provide the following after-sale services:-

  1. Merchandise return window will be one week/one month time period, after which no returns will be accepted for any item. Guarantees offered/provided by the branded items will be in accordance to their rules & regulations and www. Miyar.pk will not be held accountable if they fail to comply with their own T&C. The buyer needs to contact them directly to claim whatever guarantees they might've put forward.
  2. There will be absolutely no compromise on products quality whatsoever and if found damaged/faulty after careful inspection, either the product will not be sent to the delivery location or if found faulty by the end user, it can be immediately be returned back to the rider delivery personnel without any payment being made.
  3. Discounts will be offered on special occasions where applicable to all potential customers.

11) Successors & Our Sub Contractors:-

  • Either party can transfer the benefit of this contract to someone else of their choice or whom they consider reliably and will remain liable to the other for its obligation under the contract.
  • The supplier will be held accountable for any actions of its subcontractors, who they chooses to assist them in their duties pre-determined.

 

12) Force Majeure:-

  • In the event of any failure to comply with the T&C because of something beyond control (Act of God/Nature) of either party:-
  • The party will immediately advice/inform others about the event, so as to take any pre-cautionary measures necessary in accordance with the undesired event that has occurred which has caused any inconvenience.
  1. The party obligation will be suspended immediately for a certain reasonable time frame, which was conveyed to all concerned.
  2. The party will not be held accountable/liable for any failure, which it could not avoid at the undesirable  time but this will not affect customer's right to cancel the order and the delivery to the destination address but delays/postpone of orders can occur.

13) Privacy:-

  • Customer privacy is vital to us and we take great responsibility in protecting & securing it from misuse from unauthorized personnel.  We respect your privacy and comply with the General Data Protection Regulation.
  • This terms & conditions should be read alongside our privacy policy to have better understanding of our general rules &regulations.
  • www.Miyar.pk will solely be held responsible if consumer data have been misused or shared. We take great measures in securing your data and it will be secured under Data Protection Law.
  • We assure you that the end user data being collected will only be utilized for the sake of delivery goods to public and will not be under any conditions be shared with any unauthorized personnel. Your data is our responsibility and it will be stored into our firm's general data base for future use regarding ecommerce basic activities.

   14) Excluding Liability :-

  • The supplier does not exclude liability for any fraudulent act or omission by them or on their behalf.
  • Supplier will not be liable for any personal injury caused to consumers out of their own negligence of using products improperly without the basic guidelines followed mentioned in their user's manual.
  • The supplier will not be liable for any loss theft of the item once it was delivered and acceptable by the customer at the time of delivery after end user has inspected it carefully and signed the receipt of acceptance.

 

15) Governing Laws Jurisdictions & Complaints:-

  • The contract (including any non-contractual matters) will be governed by the laws practiced within Islamabad & Islamic Republic of Pakistan.
